Terms & Conditions
SCOPE OF SERVICES
Our agency provides professional design solutions specifically for pouches, boxes, and labels, where the exact deliverables, timelines, and revision counts are strictly defined in the initial project quotation or invoice. Any additional requests, modifications, or work performed outside the originally agreed-upon scope will be treated as an extension of the project and will be billed separately according to our standard hourly rates.
INTELLECTUAL PROPERTY & OWNERSHIP
Full ownership and copyright of the final approved design are transferred to the client only upon receipt of the full and final payment, while all preliminary sketches, unused concepts, and original working files remain the exclusive property of our agency. Unless a specific Non-Disclosure Agreement (NDA) is in place, we reserve the right to showcase the completed work in our professional portfolio, social media, and other marketing materials to demonstrate our design capabilities.
CLIENT RESPONSIBILITIES & APPROVALS
The client is solely responsible for providing all necessary product data, accurate dimensions, high-resolution brand assets, and ensuring that all legal and regulatory text required for the packaging is correct. Final proofreading for spelling, grammar, barcode functionality, and nutritional facts is the client's duty; therefore, the agency shall not be held liable for any errors, omissions, or legal non-compliance once the final design has been formally approved for production.
PAYMENT TERMS & CANCELLATIONS
A non-refundable deposit of 50% is required to initiate any design project, with the remaining balance due in full before the release of high-resolution, print-ready files. In the event that a project is paused, cancelled, or abandoned by the client after work has commenced, the initial deposit will be retained by the agency as a "kill fee" to compensate for the creative time, research, and resources already invested in the project.
PRINTING & PRODUCTION DISCLAIMER
While we deliver files according to professional industry-standard print specifications, we act solely as a design entity and are not responsible for color variations, material issues, or manufacturing defects caused by third-party printing companies. We strongly advise all clients to request and carefully review a physical press proof from their chosen manufacturer before proceeding with a mass production run to ensure the final output meets their expectations.
LIMITATION OF LIABILITY
The total liability of our agency for any claim, loss, or damage arising out of our services shall not exceed the total amount paid by the client for that specific project. We shall not be held responsible for any indirect or consequential damages, including but not limited to loss of business, loss of profits, or production delays caused by external vendors, shipping issues, or technical failures beyond our immediate control.
